A Federal High Court in Yenagoa the Bayelsa State Capital presided by Justice Isah Dachen has dismissed a suit challenging the eligibility of former President Goodluck Jonathan to contest the 2023 general elections.
The plaintiffs, Andy Solomon and Idibiye Abraham had approached the court, arguing that Jonathan having taken the oath office twice,was therefore ineligible to contest again
The crux of the matter in the suit challenging the eligibility of former President Goodluck Jonathan to contest the 2023 presidential centred around section 137, sub section (1b) and 137 subsection (3) of the Nigerian constitution
Both Plaintiffs, Andy Solomon and Idibiye Abraham ,through their counsel, had in their suit which was given accelerated hearing prayed the court to prevent Jonathan from contesting on the platform of the All Progressives Congress APC.
Delivering the judgement on the matter in which the All Progressives Congress and INEC were also joined as defendants, presiding Judge, Justice Isah Dachen says Jonathan is eligible for the 2023 presidential contest as the section of the constitution which relates taking the oath of office does not affect him, having being elected to the office of the President once.
Meanwhile, Lawyer to the plaintiffs, Seigha Agbowabi has hinted that the case would be appealed up to the Supreme Court.
